1. Agreement to Terms

By accessing or using Ọmọ Yorùbá Kids ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you are a parent or guardian agreeing to these Terms on behalf of your child, you represent that you have the authority to bind your child to these Terms. If you do not agree, you may not use the App.

2. Eligibility

The App is designed for children under the supervision of a parent or legal guardian. To create an account:

• You must be at least 18 years old (or the age of majority in your jurisdiction).
• You must be the parent or legal guardian of any child using the App.
• You must provide verifiable parental consent as required by COPPA.

The child is not a party to these Terms and cannot form a contract. The parent or guardian is solely responsible for the child's use of the App and for all activity, including any purchases, under the account.

3. Account Registration

When you create an account, you agree to provide accurate information, maintain the security of your credentials, keep your information up to date, accept responsibility for activity under your account, and notify us of any unauthorized use.

4. Subscription and Payments

4.1 Free Tier

The App offers a free tier. No payment information is required for the free tier.

4.2 Premium Subscription

Premium is billed per child: one child, plus a lower rate for each additional child, or a flat Family Plan for up to three children. Monthly and yearly billing are offered (yearly gives two months free). The exact price for your selection and region is always shown on the subscription screen before you confirm.

Subscriptions are sold through the Apple App Store or Google Play. Payment is charged to your store account at confirmation. Subscriptions renew automatically for the same period at the then-current price unless you cancel at least 24 hours before the renewal date. We never handle your payment card and cannot charge, change, or cancel a subscription ourselves. Manage or cancel anytime in your Apple ID or Google Play account settings.

We do not offer a free trial.

4.3 Refunds

Refunds are handled according to the policies of the Apple App Store or Google Play, depending on where you made your purchase.

4.4 In-App Virtual Items

The App includes cowrie shells and avatar items (“Virtual Items”) that are earned through play. Virtual Items are not purchasable with real money, have no monetary value, cannot be exchanged for cash or transferred, and are not refundable. We may change, remove, or reset Virtual Items and their availability at any time. You receive a limited, revocable license to use Virtual Items within the App; you do not own them.

5. Acceptable Use

You agree not to use the App for any unlawful purpose; attempt to gain unauthorized access; interfere with or disrupt the App; reverse engineer or decompile the App; share account credentials; use automated systems without permission; or collect user data without authorization.

6. Intellectual Property

The App and all its content — text, graphics, audio, video, logos, icons, and software — are the property of Ọmọ Yorùbá Kids (Photizo Labs LLC) or its licensors and are protected by copyright, trademark, and other laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial educational purposes.

7. User Content

Any content you or your child creates within the App (such as avatar customizations or progress data) remains associated with your account. We do not claim ownership of user-generated content, and we use this data only to provide and improve our services as described in our Privacy Policy.

8. Disclaimers

While we strive for accurate Yoruba language content, the App is an educational supplement and should not replace formal language instruction.

9. Limitation of Liability

To the maximum extent permitted by law, Ọmọ Yorùbá Kids shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill resulting from your use of the App.

10. Indemnification

You agree to indemnify and hold harmless Ọmọ Yorùbá Kids, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the App or violation of these Terms.

11. Termination

We may suspend or terminate your account and access to the App at any time, with or without cause or notice. You may terminate your account at any time by deleting it through the App settings or by contacting us at support@photizolabs.com. Upon termination, data deletion follows our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the App before the changes take effect. Continued use after the effective date constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to conflict-of-law provisions. Disputes shall be resolved in the state and federal courts located in Tennessee.
